Family Office Networks (“FON,” “we,” “us,” or “our”) operates FON Marketplace at mp.fon.network. These Terms of Use (“Terms”) govern your access to and use of the Marketplace, including the member directories, the opportunities board, and the accounts and messaging that support them (together, the “Marketplace”). By using the Marketplace, you agree to these Terms. If you do not agree, please do not use it. The Marketplace is a separate service from fon.network, which has its own Terms of Service.
1. Eligibility
The Marketplace is a private service for family-office principals and staff, qualified and accredited investors, and the professionals who serve them. You must be at least 18 years old and able to form a binding contract. Access is granted at our discretion: you may request access, and we may approve or decline any request without giving a reason.
2. Accounts & membership
- There is no self-registration. We create accounts ourselves after reviewing a request for access.
- Your account is personal to you. You may not share your credentials, let another person use your account, or hold an account on behalf of someone whose access has been declined or withdrawn.
- You are responsible for keeping your credentials confidential and for everything done through your account.
- Keep your account details accurate; you can update them from your account page at any time.
- We may review, suspend, or withdraw access at any time to protect the quality and integrity of the network.
3. Acceptable use
The value of the Marketplace depends on members treating what is in it with care. You agree not to:
- Extract data in bulk — scrape, crawl, spider, harvest, or use any automated means to collect information from the Marketplace; copy or download directory records beyond the individual records you are actively researching; or reconstruct any part of a directory outside the Marketplace.
- Resell or redistribute — sell, license, publish, or otherwise make available any directory record, contact detail, listing, or research to anyone outside your organization, or use it to build, train, or improve a competing product, dataset, or list.
- Send unsolicited marketing — use any contact detail found on the Marketplace to send spam, bulk mail, or unsolicited commercial messages, or add anyone to a mailing list. Where a record carries a do-not-mail or similar instruction, you must honor it.
- Bypass access controls — circumvent or attempt to circumvent the sign-in requirement, rate limits, or any other technical measure; reach the API or any other part of the service other than through the interface we provide; or access another member’s account or data.
- Route around our contact channels — where the Marketplace provides an enquiry form for a listing, use it. Do not attempt to obtain a recipient’s address in order to approach them outside the routing we provide.
- Misuse the service — upload unlawful, infringing, misleading, or harmful content; impersonate any person or organization; harass other members; or interfere with the operation or security of the Marketplace.
Rate limits apply to the forms on the Marketplace, and we reserve the right to rate-limit, suspend, or terminate any account we believe is being used for automated or bulk access. Nothing in this paragraph is a promise that we will detect such use, and the restrictions above apply whether or not we do.
4. Directory information & confidentiality
The directories contain information about family offices, individuals, and professionals — much of it about people who are not members of the Marketplace. Treat it as confidential and use it only for your own legitimate professional research. Do not copy, export, or disclose it outside your organization. Your right to use it ends when your access ends, and you must then stop using and delete any records you have retained.
Nothing in the directories is a representation that a person listed wishes to be contacted, is available for business, or has agreed to receive an approach from you. Most of the people described did not give us their information and are not members. If you are one of them and you want your record corrected or removed, see section 3 of our Privacy Policy — you do not need an account to ask.
5. The opportunities board
- Listings are published for information only. They are not an offer to sell or a solicitation of an offer to buy any security, interest, or product, and they are not an invitation to invest.
- We do not verify, endorse, recommend, or carry out due diligence on any listing, on any party behind a listing, or on any statement made in one. Listings are not screened for accuracy.
- Nothing on the Marketplace is financial, investment, legal, tax, or other professional advice. FON is not a broker-dealer, an investment adviser, or a placement agent, and does not act as an intermediary in any transaction.
- You are responsible for your own due diligence and for taking your own professional advice before acting on anything you find here. Any dealings you enter into with another member or with a lister are entirely between you and them.
- Every listing currently on the board is sample content. While the Marketplace is being established, the listings are illustrative examples published to demonstrate how the board works. They are not live opportunities, the assets described are not for sale, and the contact details attached to them are not those of a real seller. Do not act on them. We will remove this notice when genuine listings go live. 6. Listings & user content
- If you post a listing or send an enquiry, you are responsible for its accuracy and for having the right to share everything you include.
- You grant FON a non-exclusive, worldwide, royalty-free license to host, display, edit for length or format, and distribute that content in connection with the Marketplace.
- Do not include material non-public information, anything you are under a duty to keep confidential, or personal information about a third party that you are not entitled to share.
- We may edit, decline, or remove any listing or message at any time, and we are under no obligation to publish or to retain anything.
7. Intellectual property
The Marketplace — including the directories, their selection, structure, and compilation, the listings we produce, the software, logos, and design — is owned by FON or its licensors and is protected by intellectual-property and database laws. We grant you a limited, personal, non-transferable, revocable license to access the Marketplace for your own professional use. All rights not expressly granted are reserved.
8. Third-party links & services
The Marketplace links to third-party websites, including those of listed organizations and our parent site at fon.network. We are not responsible for those sites or their content, which are governed by their own terms and privacy policies.
9. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
10. Disclaimers
The Marketplace and all content are provided “as is” and “as available,” for general professional information. Directory information is compiled from our own records and from third-party sources; it may be incomplete, out of date, or wrong, and we do not warrant its accuracy. We make no warranties, express or implied, regarding the Marketplace, and we disclaim all implied warranties to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free. You are responsible for your own decisions.
11. Limitation of liability
To the fullest extent permitted by law, FON and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business opportunity, arising from your use of the Marketplace — including any decision you take on the basis of a listing or a directory record. Our total liability for any claim will not exceed [LIABILITY CAP — the Marketplace is not currently a paid service, so a fee-based cap does not apply; confirm the figure with counsel].
12. Indemnification
You agree to indemnify and hold FON harmless from claims, damages, and expenses arising out of your use of the Marketplace, your breach of these Terms, or your use of any information you obtained through the Marketplace.
13. Suspension & termination
We may suspend or terminate your access at any time, with or without notice, if you breach these Terms or misuse the Marketplace. You may stop using the Marketplace at any time and ask us to close your account. On termination, your license to use directory information ends immediately. Sections intended to survive termination — intellectual property, confidentiality, disclaimers, limitation of liability, and indemnification — continue to apply.
14. Governing law & disputes
These Terms are governed by the laws of [GOVERNING JURISDICTION], without regard to conflict-of-laws rules. Any dispute will be resolved in the courts located in [VENUE], unless otherwise required by law.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with an updated date; your continued use of the Marketplace means you accept the revised Terms.
